BiteBooks hosts writing by its readers, including transformative fan work. If something here infringes your copyright, tell us and we will act on it.

Sending a notice

Email dmca@thebitebooks.com. To be acted on, a notice needs all six of the elements set out in 17 U.S.C. 512(c)(3):

1. Your physical or electronic signature.
2. Identification of the work you say has been infringed.
3. The URL of the Bite you are complaining about, precisely enough for us to find it.
4. Your address, telephone number and email address.
5. A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law.
6. A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorised to act for them.

A notice missing any of these will be answered with a request for the missing part rather than acted on.

What happens then

A valid notice results in the Bite being taken down promptly. The writer is told what was removed and why, and is given the counter-notice process below.

Counter-notice

If your Bite was removed and you believe that was a mistake or a misidentification, reply to the notice from the same email as your account with:

1. Your signature.
2. Identification of what was removed and where it was.
3. A statement, under penalty of perjury, that you believe in good faith it was removed as a result of mistake or misidentification.
4. Your name, address and telephone number, and consent to the jurisdiction of the federal court for your district, or for any district in which we may be found if you are outside the United States.

We pass a valid counter-notice to the person who complained. If they do not tell us within 10 to 14 business days that they have filed a court action, the work goes back up.

Repeat infringers

An account that is the subject of repeated valid notices is closed. This policy is part of theterms.

A note on fan fiction

Fan work is welcome here and a great deal of it is lawful. A notice about fan work is handled the same way as any other: on its elements, not on an opinion about the genre.
